Restrictions for promotions and placements of HFSS products in Scotland will start from 1st of October 2026. Products considered to be HFSS include prepackaged items such as cakes, crisps and sugary drinks. Retailers will be responsible for complying with the regulations if they are a qualifying.
What Changes on 1st October?
Restrictions are in place from 1st of October 2026 and they limit the promotion and in-store placement of HFSS foods. The new regulations restrict price promotions for HFSS products such as multibuy offers and free refills for sugary soft drinks. The regulations also restrict in-store placement of these products to limit customer exposure. These restrictions also apply to online stores.
Are you a qualifying business?
To be affected by the regulations you must be a qualifying business. To be classed as a qualifying business you must offer specified food for sale and have 50 or more employees. If you are part of a franchise, you will also be classed as a qualifying business. Some independent retailers who operate as part of a symbol group or fascia could be classed as a franchise and could be considered as a qualifying business.
